Station nightclub owners appeal workersďż˝ compensation fine
(Providence-AP) -- Lawyers for The Station nightclub owners appeared in Workersďż˝ Compensation Court today to begin their appeal of a more than one (m) million dollar penalty.
Derco, L-L-C, the company owned by brothers Jeffrey and Michael Derderian, had been fined for not carrying the required workersďż˝ compensation insurance at the club.
Attorneys appeared today before a three-judge panel, the first step in the appellate process.
The Derderians� lawyers say the Worker�s Comp judge who first heard the case ignored their argument that the brothers� due process rights were violated.
They also say the statute under which the club owners were fined is unconstitutional.
The fine is the maximum allowed under state law. The lawyer for the Department of Labor and Training, which imposed the fine, says the state is simply trying to enforce the law.
